Taking A Look At Fosamax Lawsuits

The Food and Drug Administration (FDA) required Merck & Co., Inc. to post new warnings about the femur fracture risks of their drug Fosamax. A multidistrict litigation (MDL) was considered after numerous lawsuits was filed in different courts. Now, a law professor was tasked to handle Fosamax lawsuit settlement negotiations.

 

As more Fosamax complaints poured in, the New York District Court decided to establish a MDL that willassume jurisdiction on all Fosamax-related problems. The creation of this MDL happened around 2006 and now it is attending to around 900 cases.

 

Resolving the common legal issues of each individual lawsuit while making sure it is facilitated out of court is the main role of MDL. When a disagreement happens as a result of a MDL, it can be hard to control a lot of individuals which just clearly shows how hard such task will be. A former Fordham law school dean, John D. Feerick is now currently tasked to for this challenging MDL. The New York Fedural Judge John Keenan appointed him last Nov. 22, 2011. It is interesting to note that both the plaintiff’s steering committee and Merck as the defendant did not display any signs of disagreement over this appointment. He has had 21 years of private practice as a lawyer. This not even counting his role as chairman of the board of directors of many different, top-rate, trusted law-related groups.

 

A bellwether trial was made on four Fosamax lawsuits which will give us the idea how future Fosamax lawsuits will turn out. Merck won three out of the four trial which can seem pretty depressing for a plaintiff. This is not really something to be sad about as two more bellwether trials are scheduled next year. Can these future trials present a good result for people experiencing osteonecrosis of the jaw or a Fosamax femur fracture? We will see next year.
